To this end, we kindly request that you embrace and comply with our terms and conditions at all times as these are the terms on which we supply our services.<\/span><\/p><p><span style=\"font-weight: 400;\">Please read these terms carefully before you submit any booking with us. These terms tell you who we are, how we will provide services to you, how either party may change or end the contract, what to do if there is a problem and other important information.\u00a0<\/span><\/p><h4>1. About these Terms and Conditions<\/h4><p><span style=\"font-weight: 400;\">By submitting a registration to Embodiment Courses Ltd, you signify your agreement to and acceptance of our Terms and Conditions. All references to the \u201cTerms and Conditions\u201d refer to these Terms and Conditions, which are amended and updated from time to time.<\/span><\/p><h4>2. About Us<\/h4><p><span style=\"font-weight: 400;\">Embodiment Courses Ltd is registered in England and Wales under Company Registration Number <\/span><b>09887766<\/b><\/p><p><span style=\"font-weight: 400;\">Our registered office address is The Old Casino, Fourth Avenue, Hove, East Sussex, BN3 2PJ. We are registered with the Information Commissioner\u2019s Office (ICO) for data protection (reference number ZA408788). You can contact us by emailing support@embodimentunlimited.com If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provide to us in your registration form.<\/span><\/p><h4>3. Definitions<\/h4><p><span style=\"font-weight: 400;\">\u201cAgreement\u201d means these Terms and Conditions and the registration form.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cEmbodiment Courses Ltd\u201d means the limited company with whom you have entered into this Agreement.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cRegistration form\u201d\u00a0 means the form relating to registration for the conference and any preceding or following events related to that and which incorporates these Terms and Conditions.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cSession, Webinar or Online Training\u201d means any specific event, workshop or training online which Embodiment Courses Ltd offers.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cTerm \u201d denotes the periods throughout the year(s) during which we run training courses, events or workshops \u2013 in person or online.<\/span><\/p><h4>4. Limitation of Liability<\/h4><p><span style=\"font-weight: 400;\">Embodiment Courses Ltd shall not be responsible to the participant for losses that result from its failure to comply with these Terms and Conditions including, but not limited to, losses that fall into the following categories:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">loss of income or revenue;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">loss of business;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">loss of anticipated savings; or<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">loss of data<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The participant agrees that any claim against Embodiment Courses Ltd or any teacher, practitioner, employee or agent of Embodiment Courses Ltd must be brought forward within 60 days of the event that gave rise to such claim. The participant agrees any claim made after that should be discussed.<\/span><\/p><p><span style=\"font-weight: 400;\">All warranties and conditions whether implied by statute or otherwise are so far as is permitted excluded from these Terms and Conditions.<\/span><\/p><h4>5. Data Protection<\/h4><p><span style=\"font-weight: 400;\">Embodiment Courses Ltd acts as a Data Controller concerning services supplied under these Terms and Conditions and the person responsible for data protection matters is Mark Walsh.<\/span><\/p><p><span style=\"font-weight: 400;\">The Company will adhere to all applicable data protection laws and always stores data securely sent to us as outlined in our Privacy Policy.<\/span><\/p><p><span style=\"font-weight: 400;\">The Company shall ensure that data processing only occurs under the terms of these terms and Conditions and any Data Processing Agreements in place from time to time. The Company only processes personal data where it has a lawful basis to do so.<\/span><\/p><p><span style=\"font-weight: 400;\">The Company may store and process personal data via our servers located in the EU, or any other country that provides suitable and adequate security measures to protect the data. Personal Data<\/h4><p><span style=\"font-weight: 400;\">Embodiment Courses Ltd shall uphold all rights concerning the use of subjects\u2019 personal data. The rights of data subjects are contained within our Privacy Policy.<\/span><\/p><p><span style=\"font-weight: 400;\">As permitted under data protection legislation, we will store a Client\u2019s data for as long as necessary to provide our services to the Client. Information associated with your account will be kept until your account is deleted unless the information is no longer needed for the purposes agreed or for other legitimate purposes.<\/span><\/p><p><span style=\"font-weight: 400;\">Once our relationship with you as a user of our classes has terminated, we will retain personal information only to comply with legal requirements, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms and Conditions, and take any action permitted by law.<\/span><\/p><p><span style=\"font-weight: 400;\">We do not pass participants\/clients\/customers information to any third parties except those who have contractually agreed to abide by our service Terms and Conditions. Guarantee and refunds<\/h4><p>You are eligible for a refund up to 24 hours after purchase if you feel this purchase was a mistake.<\/p><p>After this point, you will only be eligible for a refund&#8230;<\/p><ul><li>On the self-care course if you watch and complete every lesson module (and try all the relevant practices) released up until September 14, 2022 (i.e. the first week of the course), turn up to both live sessions on September 6 and September 13, 2022, and apply yourself to the learning. You must then notify us by September 15 to be eligible for a refund, stating that you don\u2019t feel like you\u2019ve learnt any practical tools you can use moving forward. After this point, we will not issue any refunds.<\/li><li>On the certification course if you watch and complete every lesson module (and try all the relevant practices) released up until September 21, 2022 (i.e. the first two weeks of the course), turn up to all three live sessions on September 6, September 13,\u00a0 and September 20, 2022, and apply yourself to the learning. You must then notify us by September 22 to be eligible for a refund, stating that you don\u2019t feel like you\u2019ve learnt any practical tools you can use moving forward. After this point, we will not issue any refunds.<\/li><\/ul><p>Please note that refunds are not given simply for changing your mind, sudden changes in your financial situation, not liking the course or any member of staff, including disagreeing with a staff member\u2019s beliefs, politics or behaviour outside the course.<\/p><h4>8. Intellectual Property<\/h4><p><span style=\"font-weight: 400;\">Embodiment Courses Ltd reserves the right to all intellectual property concerning this website and the services provided. The use of the services does not give the user any ownership in the services, content, or trademark or logo used on the website.<\/span><\/p><p><span style=\"font-weight: 400;\">Any information or material provided to us is based on a non-exclusive, irrevocable, perpetual and royalty-free license to use such information and material concerning the services we provide under our Terms and Conditions.<\/span><\/p><h4>9. Changes to Terms and Conditions<\/h4><p><span style=\"font-weight: 400;\">These terms and conditions may be modified from time to time, and you are advised to check this page to see that you are reading the most up-to-date Terms and Conditions.<\/span><\/p><p><span style=\"font-weight: 400;\">By accepting our Terms and Conditions, you consent to our collection, storage, use and disclosure of your personal information as described in our Privacy Policy.<\/span><\/p><h4>10. Force Majeure<\/h4><p><span style=\"font-weight: 400;\">Embodiment Courses Ltd will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under the Agreement caused by events outside its reasonable control. Such causes include, but are not limited to power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event beyond the control of Embodiment Courses Ltd.<\/span><\/p><h4>11. Severance<\/h4><p><span style=\"font-weight: 400;\">Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.<\/span><\/p><h4>12. No waiver<\/h4><p><span style=\"font-weight: 400;\">The failure by either party to enforce any obligation under these Terms and Conditions at any time or for any period shall not be a waiver of them or the right at any time subsequently to enforce all the obligations arising under these Terms and Conditions.<\/span><\/p><h4>13. Entire Agreement<\/h4><p><span style=\"font-weight: 400;\">These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements and understandings between the parties. It is agreed that no statement, promise or inducement whether written or oral alleged to have been made by either party and which is not contained herein shall be binding or form part of these Terms and Conditions.<\/span><\/p><h4>14. Rights of Third Parties<\/h4><p><span style=\"font-weight: 400;\">No term of the Terms and Conditions will be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to it.<\/span><\/p><h4>15.
